I do not think it is a Hawthorn :?: Unless it is an Indian hawthorn.

This looks very much like Arbutus.(Killarny or Irish Strawberry tree)

It only looks a little like arbutus. I think bodhi is on the right track -
Common Indian Hawthorn
Rhaphiolepis indica
An evergreen native shrub from southern China growing 3-5m in height. It is extremely tough and has shiny, leathery leaves. White Spring flowers are profuse, held in terminal clusters and are mildly perfumed. An abundance of bluish black berries follow in Summer.

As for the marks on the leaves, May just be the old leaves starting to break down ready to fall or possibly fungal. This is a pretty tough plant so should get through it. If the problem persists in spring then maybe try fungicide?

Thanks guy's for all the info :tu: I'll ask one of the horticultur guys here an confirm what it is, there are hundreds of self seeded hawthorn and Irish strawberry trees all over where I work an they are so similar in Colour an leaf shape, unless it's flowering or fruiting I get confused :lost:

I have another hawthorn that I cut back that i know 1000% is a hawthorn it had the white flowers on it an it has started with spots but not as bad i will post a photo tonight
Should I remove all the foliage with the spots now?
