There are ancient and legendary stories of an Eminent Sydney Dentist and his mate "liberating" figs with a crowbar from the walls surrounding St Marys Cathedral in Sydney, somewhere round midnight. Alcohol may have been involved. And I dug a massive rose stump from a developers paradise by the side of a highway 30 years ago without much of a second thought. Times have changed. Now you need written permission to blow your nose (and the handkerchief must have the Correct Proportions!). A number of noxious weeds wear ties.

Hi Dumper, any contact with councils is bound to end in tears, they are just too hopeless for words. Next time just do it mate, particularly since you are doing the world a favor by removing tree weeds. the council would have left it until it was 50 metres high and had seeded all over the neighborhood then paid a contractor big bucks to take it out.

Hi Dumper, if you take a drive around more rural areas you will fine heaps of pines growing on the roadside and the collection of these ones will be no drama.

well i didnt want to sound like some kind of crim! but really thats all i do.
i would never ever take something planted/placed somewhere by some body thats for sure but when you know its a weed or will cause dramas in the future..ie; like a radiata self seeded 4inches from the actual road (ok maybe 4foot in most cases
) i dont see what the biggy is??
i have been there done that asking stuff and it never pays off, not once!!!!

but if you see any pines or what ever in farm land be sure to ask the farmer as long as he/she have not planted it they will nearly always say "bloody oath go for it" as one farmer my way said, and while i was digging away with my little mattock i could hear a sound off in the distance and down here came with his old massey fergoson with bucket scoop on back and dug dug it out for me! and then asked "what about that one" "oh and that one" and "theres another one here too..."

Hi What I would do is go out late at night and dig it out. Councils are bogged down in too much politics and red tape! sometimes you have to bend the rules.

Yep, the council chambers could catch fire and burn to the ground while they're all rushing around trying to work out what form they have to fill out in triplicate before they can call the fire brigade

I have only ever been asked once as to what i was doing and after saying this olive is perfect for bonsai they smiled and drove off. I have asked councils and there a joke so now if it's a weed and on my side of the fence out it comes eventually they will kill and remove so your just helping land care

I have been given the impression of late by some knowledgeable folk, that if you damage or remove a plant on public/council land then you are damaging public property. Due to this, if a ranger drives by, they then and there have three options which are left up to them individually to decide between.
Let you continue (this is against the law due to work cover),
Stop you and give a warning (they have to do this),
Prosecute you for damaging public property (just like if you run off the road in your car and hit a pole or tree, you need to pay for it to be re-placed).
They will not try and prosecute you, if you state it is a weed, they will just tell you to stop perhaps with a warning.
To date I do not believe there has been any convictions of people removing noxious or declared weeds from public/council land, there has been cases of people removing none weed species and being charged.

Hey Dumper just do it in the open and as you say, if it is a weed and council have some doco to say remove it then go for it.
If asked ( it will only be by a worker or maybe inspector at most), Explain that you have made sure of the job and you are just doing the environment a favour. Most will agree and thank you

Pulled up in the ute and got out the tools. Dug it out and then cleaned up after.
All was good and no one even looked at me

As Ken said, the important thing is to "remove your footprint" after you have finished. Fill in the hole, smooth over the area and take your rubbish with you and you will have very little trouble from anyone for removing weeds.

i work for a contractor that installs new st trees in east melboure.(yarra ctiy council area)
we put in new trees all the time and go back the next day 2 find some1 has liberated 1 or more....
i just chuckle to myself... dont blame them at all.
some have awesome little trunks on them and cost a pretty penny 2

I remember a few years ago, while living in Darwin, I was on first name basis with the Lord Mayor, Mr George Brown, who was also a gardener and a Bonsai guy. He gave me a ring one day and advised me that if I could get organised all the trees, Palms excepted, growing on the Median Strip on Bagot Road were fair game for any Bonsai Club members. It appeared the Council were doing a revamp of the area and were going to doze the strip and replant.
I managed to round up 5 or 6 Club members and we hit the area running, digging everything that looked half a chance of making it to a Bonsai pot. We dug over the area for 4 or 5 hours. during which time both council and POLICE vehicles passed us by, with narry a look from occupants. It was only after we had finished and were sitting under a tree having a drink that a local resident came out and told us it was about time Council had done something about the Median Strip as it had been an eyesore for far to long.
